1. Acceptance of Terms
These Terms of Service ("Terms") are a contract between you and Killion Labs Ltd ("Killion", "we", "our", or "us"), a company registered in England and Wales under company number 16905669, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.
By accessing or using the Killion website or personal finance planning service (the "Service"), you agree to these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, do not use the Service.
2. Description of Service
Killion provides a personal finance planning platform that helps users track finances, create budgets, set goals, and project future scenarios. The Service includes tools for financial visualisation, Monte Carlo simulations, historical backtests, and optional AI-powered insights. Features may change as we improve the product.
3. Important financial disclaimer
Killion Labs is NOT a registered investment adviser, broker-dealer, or financial planner.
The information provided through the Service is for educational and informational purposes only and should not be construed as personalised financial, investment, legal, or tax advice. All projections, scenarios, and AI-generated insights are hypothetical and do not guarantee future results.
You should always consult with a qualified financial advisor, tax professional, or other appropriate professional before making any financial decisions. Past performance does not guarantee future results, and all investments carry risk.
Killion Labs shall not be liable for any investment decisions or financial outcomes resulting from the use of the Service.
4. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. To access certain features you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your password and account
- Notify us immediately of any unauthorised use of your account
- Accept responsibility for all activities that occur under your account
5. User responsibilities
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Service
- Interfere with or disrupt the Service or servers
- Upload malicious code or content
- Share your account credentials with others
- Use automated systems to access the Service without permission
- Misrepresent the Service as personalised regulated advice
6. Subscription and payments
Some features of the Service require a paid subscription. By subscribing, you agree to:
- Pay all applicable fees for your chosen plan
- Automatic renewal of your subscription unless cancelled
- Provide accurate billing information
All payments are processed securely through Stripe. We do not store your payment card details.
7. Refund and cancellation policy
We want you to be satisfied with your subscription. Our refund and cancellation policy is as follows:
Cancellation
- You may cancel your subscription at any time from your account settings
- Upon cancellation, you will retain access to premium features until the end of your current billing period
- No further charges will be made after cancellation
Refunds
- Within 14 days: If you are not satisfied with your subscription, you may request a full refund within 14 days of your initial purchase or renewal
- After 14 days: Refunds are provided on a case-by-case basis at our discretion
- Annual plans: Pro-rata refunds may be available for annual subscriptions cancelled within the first 14 days
How to request a refund
To request a refund, please contact us via the contact form (billing at killionlabs.com) with your account email and reason for the refund request. We aim to process all refund requests within 5-10 business days.
Exceptions
Refunds will not be provided in cases of Terms of Service violations or account abuse.
8. Intellectual property
All content, features, and functionality of the Service—including but not limited to text, graphics, logos, icons, images, audio, software, and code—are the exclusive property of Killion Labs Ltd and are protected by international copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial planning. You may not copy, reverse engineer, or resell the Service except as the law allows.
9. Data, privacy, and cookies
Your use of the Service is also governed by our Privacy Policy and Cookie Policy. We do not sell any of your financial data. Website measurement through Google Analytics, if you accept, is for the website only and does not receive your financial accounts or transactions.
10. Third-party services
The Service depends on third-party processors, including Supabase (hosting and auth), Stripe (payments), Cloudflare (hosting and delivery), SnapTrade and Teller (read-only account linking), xAI (optional AI features), and Google Analytics (website measurement after you accept cookies). Those services have their own terms. We are not responsible for a third-party service except to the extent the law says we are.
11. Service availability and no warranty
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Simulations, market data, and linked-account balances can be delayed, incomplete, or wrong. The Service is provided "as is" and "as available" to the maximum extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except those that cannot be excluded under the laws of England and Wales.
12. Limitation of liability
To the maximum extent permitted by law, Killion Labs Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or goodwill
- Financial losses resulting from decisions made using the Service
- Service interruptions or errors
- Unauthorised access to your account
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law. Our total liability for any claim arising from the Service is limited to the fees you paid us in the 12 months before the claim, or £100 if you have paid nothing.
13. Indemnification
You agree to indemnify and hold harmless Killion Labs Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms, except to the extent caused by our negligence or breach.
14. Termination
You may stop using the Service and delete your account at any time. We may terminate or suspend your account and access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Sections that by their nature should survive (including the financial disclaimer, IP, liability, indemnity, and governing law) will survive termination.
15. Electronic communications
You agree that we may communicate with you electronically — for example, by email to your account address or by notices in the Service — about the Service, these Terms, and legal notices. Formal notices to us should go to legal at killionlabs.com or the contact form.
16. Changes to these Terms
We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes will be notified more prominently. Continued use after the effective date constitutes acceptance, except where the law requires a new agreement.
17. Assignment, severability, entire agreement
You may not assign these Terms without our consent. We may assign them in connection with a reorganisation or sale of the business. If a court finds a provision unenforceable, the rest remains in effect. These Terms, the Privacy Policy, and the Cookie Policy are the entire agreement between you and us about the Service and replace prior discussions on that subject. A failure to enforce a provision is not a waiver.
18. Governing law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law provisions. The courts of England and Wales have exclusive jurisdiction, except that you may bring a consumer claim in your country of residence if the law gives you that right.
